SCRPP is a confidential referral and monitoring program designed for physicians, nurses, pharmacists, dentists and other licensed health professionals in South Carolina with alcohol or substance use disorders, depression, anxiety, job related burnout, boundary issues, or any other mental related condition or disorder which has the potential to interfere with or impede the ability to safely and effectively treat patients.\nThe General Counsel for the SC Recovering Professionals Program (SCRPP) Serves as General Counsel for the SC Recovering Professionals Program. Provides legal counsel to SCRPP staff regarding applicable law and administrative procedure. Participates in planning overall legal or administrative activities; handles complex issues, including substantive legal analysis on a regular basis.\nPosition Logistics\nFull-time \nHiring Range: $89,000 - $120,000 (actual pay is commensurate with related experience)\nLocation: In-Office for training and consideration for work from home will be given after the successful completion of probationary period\nEducation and Experience Requirements\nJuris Doctor degree and experience as a practicing attorney.\n\nExperience managing complex programs is required.\nMust have knowledge of the policies, standards, and procedures of the participating board of LLR.\nKnowledge of the laws of South Carolina and applicable federal law; general case, statutory, and common law; judicial and quasi-judicial procedures and rules of guidance is required.\nAbility to interpret and apply laws in court-related situations is required.\nAbility to plan and/or direct staff concerning the law and legal related activities is required.\nMust be a member in good standing of the South Carolina Bar Association.\n\nPosition Overview\nLegal and Compliance Review of Correspondence \nReview and analyze letters and correspondence provided in draft form. Ensure that correspondence provides a full and complete picture of the file in a light that is fair to the participant. Revise and return correspondence to the assigned team member.\nReview and analyze the chart of inconsistencies and/or information that should be added to the correspondence. Confirm that each letter/position aligns with SCRPP policy and applicable law.\nAssess file for any possible legal concerns to include review of participant provided documents, assessment and treatment related documents, internal notes, test results and/or any testing related concerns, and examination from an adverse perspective.\nDraft higher level substantive analysis when requested or perceived necessary.\nHandle requests for SCRPP compliance letters to include individual requests by the participant or a third party; requests for ongoing compliance updates from the major hospital systems.\nProvide Legal Oversight and Communication to Stakeholders \nReceive, and respond to, calls received from attorneys. Intercept communication from attorneys directed to other SCRPP staff. Arrange facts and address issues in a manner that minimizes potential liability.\nReceive, and respond to, calls/communication received from SCDLLR.\nReview and respond to requests for participant files/document production.\nPrepare for, attend, participate, and/or respond to legal issues for RCRC, Advisory Committee, QA, IRC, and SCRPP discharge meetings. Draf and disseminate the IRC decision.\nAttend SCDLLR board meetings including assessment and minimization of any file related deficiencies and/or concerns in advance of each meeting.\nRepresent SCRPP before the various boards related to SCRPP policy, board preferences.\nResearch and stay knowledgeable concerning state and federal administrative and confidentiality law. Communicate internally and externally as appropriate. Identify and implement internal changes to bring SCRPP into compliance.\nSCRPP Leadership and Program Oversight \nParticipate in file auditing to identify internal deficits as a part of continuous improvement and risk mitigation.\nProvide input concerning personnel-related issues and SCRPP policies.\nParticipate in planning overall legal/administrative activities including interviewing and talent selection.\nLead and/or participate in RFP process\nParticipate in Participant Staffing\nAttend staffing and provide legal input when appropriate based upon the information provided.\nReview each file as it is presented to confirm that no additional information should be provided.\nAdvise staff concerning legal activities.\nMARGINAL DUTIES (5%) include the following:\nAttend all required meetings and training sessions.\nOther duties as assigned.\nPlease complete the online application to include all current and previous employment history and education.
